Consumer Statutory Rights Summary
Consumer statutory law states that up to 14 days after receiving your goods, you can change your mind and get a full refund. Your statutory rights are not limited by your 100 night trial. In addition to your statutory rights regarding faulty goods we give a 10 year guarantee that we will replace your faulty mattress. Please see clause 7 relating to the 10 year guarantee.
Under the applicable laws of your country, goods must be as described, fit for purpose and of satisfactory quality. 
Customers outside of the UK will be entitled to a repair, replacement or refund (in certain circumstances) in accordance with your country's consumer protection laws. The offer of the 100 night trail is not available for purchases made outside of the UK.

1 Delivery 
1.1 Standard delivery to mainland UK post codes for FUÜM products is free, except where indicated on the website at the point of checkout. Offshore and Eire deliveries will incur an additional cost dependant on the preferred delivery option and advised at the point of checkout.
1.2 Orders will be delivered strictly to the address entered during the order process. Any change to your delivery address, after your order has been placed and prior to your order being dispatched, must be notified by email and must be authorised beforehand. Confirmation of acceptance of the order delivery address change will be notified directly by FUÜM by email to say that this has been amended.
1.3 The estimated date for delivery of the goods will be advised on the order confirmation email.
1.4 Having delivered goods to the address you have specified in the order and or any other address agreed by us and you have been supplied with the official notification, then the items will be deemed to have been delivered and we will not be liable to you for non-delivery costs of the order. The driver will not request ID from the person that accepts the delivery but will be deemed as the person authorised to take the order and accept the delivery for you.
1.5 Orders are only delivered by us or by a third party who is contracted to undertake delivery on our behalf to your doorstep. Delivery will be to the inside of the doorstep of the property, however, should you ask the driver to enter your house and take the order anywhere else within the property or external buildings then any third-party contractor and ourselves shall not be liable for any damage to fixtures, fittings or the structure of your accommodation or external buildings which may occur (to the extent possible under applicable law). 
1.6 We use Tuffnells to deliver our goods, who may provide a tracked service dependant on the delivery service requested when the order is placed. 
1.7 Responsibility and risk for the goods passes to you when the delivery has been signed for and you take possession of the goods.
2 Collection
2.1 If for any reason, you have changed your mind within the 100 night trial period or the item is faulty, and want to return the product, we will arrange for the item to be returned or collected by us at no extra cost. 
3 Pricing
3.1 All our UK prices are in shown in Sterling (GBP) including all taxes and based on the current vatable rate on the date of purchase.
3.2 The price of the goods:
a) is in pounds sterling (£)(GBP) or Euros (EUR) 
b) includes VAT (or other applicable taxes) at the applicable rate;
c) includes the cost of Standard Delivery; and
d) excludes the cost of special delivery of the goods (if you want special delivery visit our webpage FAQ for details before you place your order)
3.3 FUÜM reserves the right to change its offer, including pricing and any discounts that are available, notwithstanding the fact the customer will pay the price applicable on the day the order is placed. Completing the purchasing process online confirms your acceptance of the price published for the item. Delivery addresses that do not qualify for our free delivery offer will be notified to you at the point of checkout before completing the purchase.
4 Returns, Refunds & Exchanges
4.1 Mattresses qualify for our 100 night trial with all other products falling under standard Consumer Statutory Law and, unless deemed faulty, will be required to be returned as new in the original packaging unopened. The cancellation period will expire after 100 days from the day you receive your mattress, or, in the case of any other goods, 14 days from the day you receive those goods. We reserve the right to refuse the 100 night trial to anyone associated with a mattress manufacturer/brand.
4.2 In the event of receiving a defective mattress we will arrange free collection or for other products a free return. Refund will be issued following return to FUÜM and a full appraisal of the defect. Free collection/return applies to UK customers only. 
4.3 Refunds can take up to 7 days to process and the credit to appear in your account. FUÜM are not liable for, and cannot take any responsibility for any bank charges that you may incur during the refund process.
4.4 If damage has been caused to the product or if the product has been used, we reserve the right to refuse a refund or exchange. 
4.5 To exercise the right to cancel, you must inform us by sending cancellation details on the template form below. Please complete the purchase details and paste into the body of an email quoting your name and purchase date as reference.

5 Payment
5.1 Payment is accepted by the following methods; Credit card, Debit card, Amazon Pay, Paypal, Cheque and Money Transfer. We do not accept cash.
5.2 FUÜM retains ownership and title to goods sold until full payment is received can cleared in FUÜM’s bank account. FUÜM reserves the right to cancel any Order or delivery, in case of non-payment by the Customer or discrepancies relating to payment.
5.3 The Customer fully authorizes FUÜM to use the payment card information supplied to pay for the purchase transaction and that such payment means legally giving access to sufficient funds to cover all costs of the purchase order. FUÜM will not be held liable for any fraudulent use of any of the payment methods used in any purchase.
5.4 Any transaction of any payment is processed within secure process data encryption and no information provided by the customer is intercepted by third parties. However, in the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.
5.5 It is recommended the customer retains the confirmation email issued from FUÜM as proof of the transaction and saves the banking details of the transaction.
6 Product Availability
6.1 We endeavour to keep all products available for immediate fulfilment of all orders received. Should, for any reason, the product be unavailable at any point of the shipping process, the purchaser will be notified by email or telephone and a new in stock availability date be given. In such circumstances, the customer will have the option to receive a refund until the item is back in stock. There will be no charges for this transaction. In case of unavailability of a product before or after order, FUÜM cannot be held liable for any loss suffered by the customer, nor liable to any damages.
7 10 year Product Warranty
7.1 For full detail please refer to our warranty section, which can be found on our website in FUÜM terms and conditions 
7.2 Whilst FUÜM will replace any faulty mattress under our 10 year guarantee, the guarantee may be invalidated if you have not taken reasonable care of your mattress. This guarantee does not apply to normal wear and tear, damage as a result of any kind of accident or abuse, or if the mattress is in a soiled or unreasonable condition. 
7.3 Guarantee claims must be notified within 30 days of discovery of the defect.
7.4 The mattress must be in its original specification. If repairs or alterations to the product have been made without our prior written consent it will invalidate this guarantee.
7.5 FUÜM may ask for you to supply photographs of the mattress to view any visible fault. These photographs will be used to determine whether a replacement is necessary. FUÜM reserves the right to determine if the mattress is deemed faulty and qualifies for replacement or refund under warranty. Failure to supply photographs of the fault may result in a replacement being delayed or in some circumstances not being replaced.
8 Intellectual Property
8.1 All FUÜM items and copy using the FUÜM brand and LOGO displayed on the Website, including trademarks are protected under copyright and intellectual property law. 
9 Written Communications
9.1 At FUÜM we love and care for the planet and we know you do too. Contact via the website and email is our preferred way of communicating with you. By entering into a transaction with FUÜM you are agreeing to accept that we will communicate primarily electronically with you and such communication will comply with any legal requirements in normal written correspondence. 
10 Force Majeure
10.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event"). Force Majeure Event includes any act, event, non-happening, omission accident or Act of God beyond our reasonable control.
10.2 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. 
11 Variation of Terms and Conditions
11.1 FUÜM reserve the right to amend and revise any of our T&C’s from time to time with changes posted on our website and through social media should it be deemed necessary.
11.2 Any orders placed with us will be subject to the policies and terms and conditions in force at the time unless any change to those policies or these terms and conditions is required to be made by law or governmental authority. If you have placed an order and it is not shipped, we will notify you of the change to those policies or these terms and conditions before we send you the delivery confirmation and despatch the order. In accepting the order, we will have the right to assume that you have accepted the change to the terms and conditions. Should you not accept these changes and you notify us to the contrary within 7 working days of receipt we will cancel your order.
12 Privacy and Security Policy
12.1 Entering into a sale with FUÜM online or purchasing over the phone will require you to provide certain personal information to the credit card company or bank as a necessary prerequisite to able to place an order.
12.2 The information you provide will be kept safe and secure, you may contact us at any time for access to your information, some of the information will be stored primarily by our merchant services provider, and not by FUÜM. This will allow you to be sure that the information is logged correctly and up to date.
12.3 You will be free to opt out of any marketing opportunity that is using your correspondence information for any purpose, but linked solely to FUÜM. We will only use any information which we believe is of a legitimate interest to our customers. You are free to opt out by contacting hello@fuum-mattress.com
13 Other Terms & Conditions
13.1 Customers placing an Order have read and acknowledge Product details or are deemed to have contacted the customer service if they consider that it there is insufficient information.
13.2 We at FUÜM have chosen to design our products to the highest standards and do not intent to change them. If for any reason we decide to modify a product, we reserve the right at any time to change the design, manufacture, materials or any other element of its Products. We will post any changes on the website, which will be legally binding at day of purchase.
13.3 The FUÜM website primarily only uses actual FUÜM products unless we use an informative CGI to explain the characteristics of a product and make it more informative for the customer to understand. However, colours can differ due to screen resolutions. Pantone codes are available on request should you wish to match the colour for range coordination. This still may vary in a minor way.
13.4 The products we make are manufactured by highly reputable and approved company’s only and all technical and safety requirements are taken into account and considered when producing our products. Rigorous testing that includes both safety, fire and wear and tear testing is carried to ensure our products meet and surpass UK laws and regulations requirements.
13.5 FUÜM reserves complete freedom of its offer on the Website and is likely to change the Products and / or services offered for sale from time to time without prior notice. 
14 Law and Jurisdiction
14.1 By committing to the purchase of a FUÜM product on the FUÜM website it will form a contract with FUÜM and the purchaser. All transactions will fall under and be governed by English law. Should a dispute arise from any transaction it will be subject to the non-exclusive UK laws and regulations. 
15 100 Night Mattress Trial
15.1 FUÜM has the 100-day trial gives you the peace of mind to purchase and test the mattress for 100 nights. If for any reason, you are not satisfied with your purchase during this 100 day period, we will be happy to take you mattress back.
15.2 Refund will be made once the mattress is collected, returned and assessed by our QC team for any damages not associated with the normal usage of a mattress, as stipulated in FUÜM general terms and conditions. Collections for UK customers are free of charge, although we require you to package and hand the mattress to our courier company. FUÜM reserve the right to refuse the 100-night trial to anyone we find associated with another mattress manufacturer or mattress brand. 
15.3 The 100 night trial gives you the peace of mind and enables you to properly assess the quality and comfort of the mattress. If, for whatever reason you decide to the return the mattress, we ask that you give us constructive feedback to allow us to improve the sleep experience with a FUÜM mattress.
15.4 Should we have grounds and believe that you are returning the mattress for ingenuine reasons, we will reserve our right to refuse to accept the return and reserve the right to refuse to sell any FUÜM products to you in the future, either through the website or otherwise listed.
16 Discount Codes
16.1 Discount codes are only redeemable on full priced purchases at checkout on the site or checkout by phone. These discount codes cannot be used with our interest-free credit provider on the monthly payments scheme. All published prices are correct at the time of release and the discount codes will be limited to the number issued for each promotion. They may have a termination date and will only be able to be used once and only one voucher per person/purchaser. These conditions of sale will be clearly published on the day of issue.
16.2 FUÜM cannot be responsible for any third-party sites who publish FUÜM discount or promotional codes with or without its permission.
